Texas Radiotherapy TEXT MESSAGING TERMS OF USE
By “Opting In” to or using a “Text Messaging Service” (as defined below) from Texas Radiotherapy, you accept these Terms & Conditions.
This agreement is between you and Texas Radiotherapy or one of its affiliates. All references to “Texas Radiotherapy,” “we,” “our,” or “us” refer to Texas Radiotherapy,1300 W. Terrell Ave. Fort Worth, Texas 76104.
Definitions
“Opting In,” “Opt In,” and “Opt-In” refer to requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, or otherwise consenting to receive one or more text messages.
“Text Messaging Service” includes any arrangement or situation in which we send one or more messages addressed to your mobile phone number, including text messages (such as SMS, MMS, or successor protocols or technologies).
Consent to Text Messaging
By consenting to receive text messages from us, you agreed to these Text Messaging Terms and Conditions, as well as our https://texasradiotherapy.com/privacy-policy, incorporated herein by reference.
E-Sign Disclosure
By agreeing to receive text messages, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by replying STOP.
Text Messaging Service
By opting in to receive text messages, you acknowledge and represent to Texas Radiotherapy that you are the current wireless service plan subscriber and/or an authorized user of the mobile phone number. By providing my phone number, I consent to receive text messages from Texas Radiotherapy for appointment reminders and general two-way communication about Health Information. Message and Data Rates may apply. You must inform us immediately if your mobile phone number changes and/or you no longer are an authorized user of the mobile phone number.
Text Message Service Privacy Policy
We respect your privacy. We only use information you provide through this service to transmit your mobile messages and respond to you. This includes, but isn’t limited to, sharing information with platform providers, phone companies, and other vendors who assist us in the delivery of mobile messages. Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. No mobile opt-in will be shared with third parties/affiliates for marketing/promotional purposes. We reserve the right always to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property. This Text Message Service Privacy Policy applies to your use of the Text Message Service and isn’t intended to modify our general “Notice of Privacy Practices,” which may govern the relationship between you and us in other contexts.
Costs of Text Messages
We do not charge you for the messages you send and receive via this text message service. But message and data rates may apply, so depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider. Frequency of Text Messages
This Text Messaging Service is for conversational person-to-person communication between you and our employees. We may send you an initial message providing details about the service. After that, the number of text messages you receive will vary depending on how you use our services and whether you take steps to generate more text messages from us (such as, asking questions to our care team).
Opt Out of Text Messages
If you no longer want to receive text messages, you may reply to any text message with STOP. As a person-to-person communication service, opt-out requests are specific to each conversation between you and one of our employees and their associated phone number. After unsubscribing, we may send you confirmation of your opt-out via text message.
Privacy and Security
Please update us promptly if your mobile number changes. It is your responsibility to provide us with a correct mobile number and update us with any changes.
We recommend you use a password to protect the information on your mobile device. Text messages may include protected health information (PHI). Since text messaging is unencrypted, there is a risk that this PHI could be intercepted or viewed by third parties, including others who look at your device. When you choose to get text messages from us, you
do so at your own risk. The use and disclosure of PHI in text messaging may be governed by other privacy notices, including applicable HIPAA Notice of Privacy Practices.
In Case of An Emergency
I understand that this text messaging service should not be used for medical emergencies or other medical issues that must be handled promptly. If you experience a medical emergency, call 911, or visit your nearest emergency room/healthcare provider.
Liability
We are not responsible for any charges, errors, or delays in text messaging delivery or undelivered messages caused by your carrier or third-party service providers. Messages sent by text may not be delivered if the mobile device is not in range of a transmission site, or if the network is down. Factors beyond the power of wireless carriers may get in the way of message delivery. This may include the terrain, how close you are to buildings, foliage, weather, and your equipment. We and your wireless provider will not be liable for losses or damages that come from: a message not delivered, a message delivered late, or inaccurate or incomplete content in a text message.
