Text Messaging Privacy Policy

Texas Radiotherapy Text Messaging Service (the “Service”) is a text message service that enables patients of Texas Radiotherapy et al (“we”, “us”, “our”) patients to send and receive communications via short message service (“SMS”) relating to their healthcare. We respect your privacy and are committed to protecting it through our compliance with this privacy policy (“Privacy Policy”). 

This Privacy Policy governs how we treat the Personal Information that we collect and receive from you when you opt-in to receive SMS and other text messages from us. This Policy applies to SMS communications and other text messages sent through our messaging technologies and does not supersede our broader Privacy Policy, which governs all other aspects of data and usage. 

Acceptance of the Privacy Policy and Terms of Use 

This Privacy Policy is effective with respect to any data that we have collected, or collect, about and/or from you, according to our terms of use, found in the Text Messaging Terms and Conditions, which are incorporated herein by reference. Please read this Privacy Policy carefully before you use the Services. By using the Service, you accept and agree to be bound and abide by this Privacy Policy. If you do not want to agree to the Terms and Conditions or this Privacy Policy, you must not access or use the Services. 

What Information is Collected 

We collect information you voluntarily provide directly to us, information that we collect automatically when you interact with our services, and information collected from third parties. The categories of personal information that we collect for the purposes of SMS communication are described below. 

Personal information: We collect certain personal information, such as your phone number, name, and contact information. 

Message content: We collect the content of the messages you send and receive from us. The content may include appointment reminders and scheduling, medical follow-ups and consultation notifications, responses to patient questions or requests. 

Opt-In Information: We collect your SMS consent information. 

Service Interaction Data: We collect information about your interactions with our services, such as appointment details, questions sent to our care team members, and responses to our services. 

Use of Your Information

When you opt in to receive SMS messages, we may use your information to provide essential services updates. Service updates are transactional messages related to the services we provide, such as care team appointment confirmations and cancellations, care plan updates, regular care team member check-ins, and care team support. 

Sharing of Your Information 

Your mobile opt-in will not be shared with third parties/affiliates for marketing/promotional purposes. Information may be shared with healthcare providers involved in your care for coordination of treatment. We may share your information, including your SMS opt-in or consent status with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies and other vendors who assist us in the delivery of text messages. Mobile information collected for SMS communications will not be shared or sold to third parties or affiliates for marketing purposes. 

To comply with legal obligations, we may disclose your information if required to do so by law or in the good-faith belief that such action is necessary to comply with applicable laws (such as U.S. copyright law), in response to a court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement or other governmental agencies. 

Opting Out 

You may opt-out of receiving SMS communications at any time. If you wish to unsubscribe from SMS messages, you can reply with the word STOP and you will no longer receive messages. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have unsubscribed. After this, you will no longer receive SMS messages from us. 

Message Rates and Frequency 

While Texas Radiotherapy does not charge a text message fee, standard message and data rates may apply depending upon your wireless carrier and plan. Contact your wireless phone carrier for your specific plan details. 

The number of messages you may receive varies depending upon how you utilize the service. See “Text Messaging Terms and Conditions” for details. 

No Liability 

You understand that electronic communications may be accessed by unauthorized parties when communicated across the Internet, network communications facilities, or other electronic means. You agree that we are not responsible for any electronic communication and/or any of your data which may be lost, altered, intercepted or stored without authorization during the transmission of any data whatsoever across networks not owned and/or operated by us. We do not guarantee 

that your information will not be misused or disclosed to third parties. We will not have any liability to you for any such misuse or disclosure. 

Except as required or allowed by law, we will not use or disclose your information for any purpose for which you refuse us consent or later withdraw your consent. If you withdraw consent, you agree that despite this withdrawal we may continue to use the information

previously provided to us to the extent that we are legally or contractually obligated to do so and to the extent necessary to enforce any contractual obligations you may have to us.

Security 

It is your responsibility to provide us a correct mobile number and update us with any changes. We recommend using a password to protect the information on your mobile device. Text messages may include protected health information (PHI). Since text messaging is unencrypted, there is a risk that this PHI could be intercepted or viewed by third parties, including those who look at your device. 

We take appropriate technical and organization measures to protect your information from unauthorized access, use, or disclosure. However, please note that while we strive to protect your personal information, no system can be completely secure. By using our text messaging service, you acknowledge that some level of risk is inherent in online communications. If a security breach causes an unauthorized intrusion into our system that materially affects you, then we will promptly notify you in accordance with applicable legal requirements. 

Changes to this Privacy Policy 

We reserve the right to make changes to this Privacy Policy and to our information gathering and dissemination practices. If we decide to change this Privacy Policy, which we may do at any time without notice to you, we will post those changes to our website. We suggest that you periodically check the site for changes to this Privacy Policy.
